ELMIRA MAN PLEADS GUILTY TO CHILD PORNOGRAPHY
ROCHESTER, N.Y.-- John R. Maggese, 44, of Elmira, New York, plead guilty before U.S. District Judge David G. Larimer, to a felony charge of possession of child pornography, U.S. Attorney Terrance P. Flynn of the Western District of New York announced today. Possession of child pornography carries a maximum penalty of 10 years imprisonment, a fine of $250,000, or both. Assistant U.S. Attorney Tiffany Lee, who handled the case, stated that
from July 2003 through August 2005, the defendant possessed images of child
pornography on a computer he owned. He had received these images over the
internet. The images had been shipped and transported in interstate and foreign
commerce. Some of the child pornography images depicted minors under twelve
years old. Sentencing is scheduled for May 24, 2007, at 2:00 p.m. EST, in Rochester, N.Y., in front of U.S. District Judge David G. Larimer.
